1. Who we are
Just Make An Offer For It is operated by Jon Buck Enterprises, LLC, a Missouri limited liability company ("we," "us," or "our"). The Site is intended for people in the United States.
2. Acceptance and eligibility
By using the Site, you agree to these Terms. You must be at least 18 years old and legally able to enter a contract to submit an offer. If you act for another person or organization, you represent that you have authority to do so.
3. What the Site does
The Site displays property offered by one owner and lets visitors propose cash, a trade, trade plus cash, or—for designated items—a rental with dates, intended use, and a total rental price. A submission starts a conversation; it does not reserve an item or dates, charge a payment method, transfer property, or create a completed sale or rental. We may accept, reject, counter, or decline any request.
4. Listings and availability
We try to describe items accurately, including known material condition information, but colors, dimensions, photos, and descriptions may not capture every detail. Items may be withdrawn, corrected, marked sold, or made unavailable at any time. No listing is an appraisal or a promise that an item is suitable for a particular use.
5. Your submissions
You agree to provide accurate contact, offer, trade-item, ownership, condition, and photo information and not submit unlawful, threatening, deceptive, infringing, malicious, or automated content. You represent that you own any proposed trade item, have authority to transfer it, and have disclosed known liens, damage, missing parts, safety issues, recalls, and material defects. You give us permission to use your submission only as reasonably needed to evaluate and administer your offer, communicate with you, protect the Site, and comply with law.
6. Acceptable use
You may not interfere with the Site, probe or bypass security, scrape listings at scale, impersonate another person, introduce malware, misuse contact information, or use the Site to violate law or another person's rights.
7. Intellectual property
The Site's branding, layout, text, graphics, and original photographs are owned by or licensed to us and are protected by law. You may view and print Site content for personal evaluation of an item, but may not republish, sell, or commercially exploit it without written permission.
8. Third-party services
The Site is hosted through OpenAI Sites, offer communications are managed through third-party customer communication providers, and accepted transactions may use Square. Those providers may apply their own terms and privacy notices. We do not control third-party services and are not responsible for their independent acts or outages.
9. Site disclaimer
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES ABOUT THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THIS SITE DISCLAIMER DOES NOT REPLACE THE SEPARATE TERMS THAT APPLY TO AN ITEM SALE OR LIMIT RIGHTS THAT CANNOT LAWFULLY BE WAIVED.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site. Our total liability for a Site-related claim will not exceed the greater of $100 or the amount you paid us for the item directly involved in the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
11. Governing law and disputes
Missouri law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, you and we agree to make a good-faith attempt to resolve it informally. Any court proceeding must be brought in a court with jurisdiction in Missouri, unless applicable consumer law requires otherwise.
